JJ RIBS undertake to transport divers/passengers to and from the agreed site(s), to deploy and recover
safely divers from the water and to provide standard safety and back-up facilities. JJ RIBS does not
undertake to provide advice regarding dive planning or recommendations relating to scuba diving practices. It is the individual responsibility of divers to dive within the limits of their own training and experience.
Booking
The vessel is not considered booked until the completed Booking Form and agreed deposit has been received.
Provisional bookings by phone, fax or e-mail will be held for seven days pending receipt of the Booking Form and
deposit. Every person making a booking for or on behalf of a club or group warrants and confirms that he/she has
the authority of those individual(s) on behalf of whom the booking is made and that each person agrees to be bound by these conditions. It is the responsibility of the charterer to ensure that all members of the group are familiar with these terms and conditions which shall apply to the booking.
Deposit
The deposit, as detailed on the booking form, will be paid in full at the time of booking. Clubs or groups making
multiple bookings may at the discretion of JJ RIBS pay one deposit, which will be transferred from one booking to the next. All Cheques should be made payable to JJ RIBS
Cancellation policy
In the event of a customer cancellation JJ RIBS will make every effort to resell the charter and if able to do
so will refund money paid less any expenses incurred. If the charters is unable to be re-sold, the following shall
apply:
• more than ten weeks prior to charter - full refund
• four to ten weeks prior to charter - loss of deposit paid
• two to four weeks prior to charter - 50% refund of monies paid
• less than two weeks - no refund applicable
If owing to circumstances beyond the control of JJ RIBS, the charter is cancelled either by JJ RIBS or any other party acting as agent for JJ RIBS, a full refund of monies paid will be given.
Payment of balance
It is the charterers responsibility to ensure that the balance, as detailed on the booking form, is paid in full, no less than 28 days prior to the day of the charter. Payment may be made in cash (only by special delivery if posted) or by cheque made payable to JJ RIBS.
Insurance
JJ RIBS. is fully insured for bodily injury or accident to passengers on board to a maximum of £3,000,000
(three million pounds sterling). Our insurance does not cover charterers who are away from the vessel or its tender whilst engaged in diving or other water sports or activities. JJ RIBS. accepts no liability for loss or damage to personal property including diving equipment and any equipment left on the boat overnight is expressly left at the owner's risk.
Safety
The final decision regarding the safety of the vessel, its crew and those on board rests with the Skipper. The final decision relating to the suitability of the weather for sailing or diving operations will be made by the Skipper, whose decision shall be final and binding. The skipper may cancel or amend the trip at any time if he believes the conditions are, or are likely to become unsuitable for the proposed charter. JJ RIBS. strongly recommends that all persons engaged in diving activities are equipped with a Reel and Surface Marker Buoy (SMB) to mark their position in the water and that each diver is so equipped. It is recommended that Reels and SMBs are deployed as directed by the Skipper. JJ RIBS. and the Skipper reserve the right to refuse diving activities to any person, who in the sole and absolute discretion of the Skipper are not so equipped.
Diving charters
The charterer shall provide sufficient instructors and/or other competent persons to supervise all diving activities and use of diving equipment and shall be fully responsible therefore. JJ RIBS. and its crew shall not be responsible for any accident or injury caused to any person or persons arising out of diving or use of any equipment. It is the charterers responsibility to ensure that the dive sites chosen by them are suitable for the members of their group given their current level of training, experience and fitness. The Charter Party shall be responsible for ensuring compliance with all matters arising from the Merchant Shipping Act, the Protection of Wrecks Act and any legislation regarding the laws of salvage.
Changes to proposed itinerary
JJ RIBS. reserves the right to cancel or amend the scheduled charter in any way considered desirable due, in
its sole and absolute discretion, to adverse weather or any other conditions. JJ RIBS. also reserves the right
to alter published prices in accordance with any major changes in cost which may occur between the time of booking and the time of departure.
